A federal district court has declined to pause U.S. Citizenship and Immigration Services’ implementation of the statutory one-year limit on employment authorization documents issued to Temporary Protected Status beneficiaries.
The August 5, 2026, decision in Venezuelan Association of Massachusetts et al. v. U.S. Citizenship and Immigration Services et al., No. 1:26-cv-13038 (D. Mass.), replaces the court’s temporary administrative stay issued on July 21, 2026. Employers should therefore continue to follow current USCIS guidance when determining the validity of TPS-based employment authorization and completing Form I-9 reverification.
